Dr Aleksander Godhe LLB LLM FCIArb FHEA Presents - Domestic and International Adjudication: The Future of Construction Dispute Resolution and Beyond

This event examines statutory and contractual adjudication from both domestic and international perspectives.


It begins with reflections on the key findings of the 'Construction Adjudication in the UK: Tracing trends and guiding reform' reports, that were co-authored by Dr Godhe at King’s College London in partnership with The Adjudication Society. The reports identified several areas for potential reform, including:

(1) the removal of exceptions and exclusions under the Housing Grants, Construction and Regeneration Act 1996;
(2) the introduction of guidelines on adjudicators’ conflicts of interest;
(3) the piloting of publication of adjudication decisions; and
(4) the promotion of greater diversity among adjudicators.

The lecture then adopts a comparative perspective on statutory adjudication. While the British system was the first of its kind, it has not been widely replicated internationally. Most common law jurisdictions have instead adopted more restrictive statutory adjudication regimes. The lecture will also introduce the concept of contractual adjudication and examine how it has been promoted through dispute boards, ADR mechanisms in civil law jurisdictions and through the work of the United Nations Commission on International Trade Law.

The lecture concludes with reflections on the future of statutory and contractual adjudication in the construction sector and beyond. It explores three potential pathways for further internationalisation and promotion of adjudication:

(1) the development of model adjudication clauses;
(2) the adoption of model laws; and
(3) the establishment of an international convention on adjudication.

BIO:
Dr Aleksander Godhe is the Michael Brown Lecturer (Assistant Professor) at the Centre of Construction Law & Dispute Resolution, King’s College London and a Visiting Fellow at the Stockholm Centre for Commercial Law, Stockholm University. 

His specialism is in dispute resolution, construction law and private international law. He is the co-author of the ‘Construction Adjudication in the UK: Tracing trends and guiding reform’ reports and a joint winner of the 2024 SCL Hudson Prize. Aleksander also acts as an Independent Consultant in dispute resolution and has practical experience with High Court commercial litigation and international arbitration matters under the SIAC, DIAC, LCIA, ICC, SCC, VIAC and ICSID arbitration rules. He is a Visiting Lecturer in English Commercial Law at the British Law Centre, a charity delivering executive English law teaching across Central and Eastern Europe, and at the Africa Construction Law Training Academy. 

Aleksander is the Co-Chair of the International Bar Association Task Force on Contractual Adjudication and Deputy Committee Editor of the Construction Law International journal. He is also a Fellow of the Chartered Institute of Arbitrators (FCIArb), Fellow of the Higher Education Academy (FHEA) and a member of the Society of Construction Law, the London Court of International Arbitration Users’ Council and the Society of Legal Scholars.
